1. Agreement

By accessing our website or engaging Technetium Kenya for services, you agree to these terms. If you disagree, do not use our site or services. Specific projects may also be governed by a separate written agreement (statement of work / contract), which prevails if it conflicts with these terms for that project.

2. Services

We provide professional technology services (e.g. software, websites, apps, design, related consulting). Deliverables, timelines, and fees are as agreed in writing for each engagement.

3. Client responsibilities

• Provide accurate information, timely feedback, and necessary access or materials.
• Ensure you have rights to any content or assets you supply.
• Comply with applicable laws (including marketing, data, and export rules).

4. Intellectual property

Unless otherwise agreed in writing, ownership of deliverables and licences to use them are set out in your project contract. Pre-existing materials, tools, and frameworks remain ours or our licensors’ property.

5. Payment

Fees, deposits, milestones, and expenses are as quoted or contracted. Late payments may suspend work. Taxes apply where required by law.

6. Warranties & liability

Services are provided professionally and in line with agreed specifications. To the maximum extent permitted by law, we are not liable for indirect or consequential losses. Our total liability for a claim is generally limited to fees paid for the relevant engagement in the months preceding the claim—unless a signed contract states otherwise.

7. Third parties

Our website may link to third-party sites or services. We are not responsible for their content or practices.

8. Termination

Either party may terminate a project as set out in the applicable contract. We may suspend or refuse service for legal, security, or non-payment reasons.

9. Governing law

These terms are governed by the laws of Kenya, unless a written contract specifies otherwise. Courts in Kenya shall have non-exclusive jurisdiction unless agreed otherwise.
